Terms of Service

These Terms of Service ("Terms") govern your use of the TradeWire platform and services ("Service") operated by TradeWire ("we," "us," or "our"). By using our Service, you agree to these Terms.
1. Service Description
TradeWire provides automated sales systems services for contractors, including but not limited to: automated lead follow-up calling, AI phone answering (receptionist), lead qualification, appointment booking, follow-up sequences, email outreach, and cold calling. Our Service uses artificial intelligence to conduct phone calls and communications on your behalf.
2. AI Disclosure
You acknowledge that TradeWire uses automated voice technology to make and receive phone calls. While our AI is designed to sound natural and conversational, calls are conducted by an artificial intelligence system, not a human. We comply with all applicable disclosure requirements and our AI identifies itself appropriately when required by law.
3. Free Trial
We offer a 7-day free trial of our Service. To start a trial:
- A valid payment method (credit card) is required at signup
- You will not be charged during the 7-day trial period
- If you do not cancel before the end of day 7, your selected plan will activate and billing will begin on day 8
- At the end of your trial, you may: continue monthly, switch to quarterly billing (10% discount), cancel at no cost, or request a tuning adjustment ($250 fee plus an additional test week)
4. Billing & Payment
- Monthly billing: Charged on the same date each month following your trial
- Quarterly billing: Charged every 3 months at a 10% discount from monthly rates
- Setup fees: A one-time setup fee is charged upon plan activation (varies by tier)
- All fees are in US dollars and are non-refundable except as required by law
- We reserve the right to change pricing with 30 days' notice
5. Cancellation
You may cancel your subscription at any time. Upon cancellation:
- Service continues through the end of your current billing period
- No further charges will be made
- Setup fees are non-refundable
- We will deactivate your automated systems and cease all calling on your behalf
6. Call Recording & Consent
TradeWire may record phone calls made through our Service for quality assurance, training, and compliance purposes. You are responsible for ensuring compliance with applicable call recording laws in your jurisdiction, including but not limited to obtaining necessary consent from call participants. We will configure call handling to comply with your state's recording consent requirements upon setup.
7. TCPA Compliance
You agree to use our Service in compliance with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state telemarketing laws. You represent that you have proper consent to contact the leads and phone numbers provided to our system. TradeWire is not responsible for calls made to numbers provided by you without proper consent.
8. Your Responsibilities
- Provide accurate business information for AI training
- Maintain proper licensing for your contracting business
- Ensure lead lists and contacts have appropriate consent
- Respond promptly to hot lead transfers during business hours
- Not use the Service for any unlawful purpose
9. Limitation of Liability
To the maximum extent permitted by law, TradeWire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of our Service. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
We do not guarantee specific results, conversion rates, or revenue outcomes. ROI figures presented in our marketing materials are estimates based on industry averages and are not guarantees of performance.
10. Indemnification
You agree to indemnify and hold harmless TradeWire from any claims, damages, or expenses arising from your use of our Service, your violation of these Terms, or your violation of any applicable law.
11. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime. We will notify you of planned maintenance when possible.
12. Intellectual Property
TradeWire retains all rights to our platform, technology, AI models, and proprietary systems. You retain ownership of your business data, customer information, and call recordings.
13. Modifications
We may update these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State in which TradeWire is incorporated, without regard to conflict of law provisions.
